Terms of Use

These Terms of Use ("Terms") govern your access to and use of the Fair Tips mobile application (the "App") and related services. In these Terms, "we," "us," and "our" refer to the developer of the App. By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.

1. Eligibility and Acceptance

You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to use the App. By using the App, you represent that you meet this requirement and that you have the legal capacity to enter into these Terms.

2. Description of the Service

Fair Tips is a tip calculator that helps you calculate tips based on the pre-tax amount of a bill. It determines the combined local sales tax rate for your area — using your device's location or a zip code you enter — and separates that tax out so your tip is applied to the pre-tax subtotal. The sales tax rate data is stored on your device and the lookup is performed on your device. The App does not require you to create an account.

3. No Tax, Financial, or Professional Advice

The App is provided as a convenience tool for estimating tips and sales tax and does not constitute tax, financial, accounting, or professional advice.

  • Estimates only. Sales tax rates change over time and can vary by exact address, product or service category, and special district. The rates and calculations the App provides are estimates and may not reflect the precise amount on your receipt.
  • Your responsibility. You are responsible for verifying the actual tax, subtotal, and total on your bill and for deciding how much to tip. The final amount you pay is always your decision.
  • No liability for reliance. To the maximum extent permitted by law, we are not responsible for any overpayment, underpayment, or other loss arising from your reliance on the App's calculations.

4. Location Permission

The App may ask for permission to access your device's location in order to determine your local sales tax rate. Granting location access is optional — you may instead enter a zip code manually — and you can change or revoke this permission at any time in your device settings. 5. Subscriptions and In-App Purchases

Fair Tips is free to download and offers an optional premium tier, unlocked through in-app purchases sold via the Apple App Store. The available options, features, prices, and any free trial are displayed in the App at the time of purchase and may vary by region.

Billing, Renewal, and Cancellation

  • Payment is charged to your Apple ID account at confirmation of purchase.
  • Auto-renewing subscriptions automatically renew for the same period at the then-current price unless auto-renew is turned off at least 24 hours before the end of the current period.
  • Your account is charged for renewal within 24 hours prior to the end of the current period.
  • You can manage or cancel your subscription, and turn off auto-renewal, in your Apple ID Account Settings after purchase. Cancellation takes effect at the end of the current billing period.

Free Trials

  • Where offered, free trials are available only to users who are eligible under Apple's rules and have not previously used a trial or introductory offer for the applicable subscription.
  • If you do not cancel before the free trial ends, your subscription will automatically begin and your Apple ID will be charged.
  • Any unused portion of a free trial is forfeited when you purchase a subscription, where applicable.

Refunds

All purchases are processed by Apple, and pricing, billing, refunds, and cancellations are handled in accordance with the Apple Media Services Terms and Conditions. Except where required by law, purchases are non-refundable, and we do not directly process refunds. Refund requests must be made through Apple.

6. Acceptable Use

You agree not to:

  • Use the App for any unlawful purpose or in violation of these Terms;
  • Attempt to reverse engineer, decompile, interfere with, or gain unauthorized access to the App or its systems;
  • Use the App in a way that could disable, overburden, or impair its operation, or attempt to circumvent purchase or usage limits.

7. Intellectual Property

The App, including its design, software, text, graphics, and logos, is owned by the App's developer and is protected by intellectual property laws. We grant you a limited, personal, non-transferable, non-exclusive license to use the App for its intended purpose. You may not copy, modify, distribute, sell, or lease any part of the App except as permitted by these Terms.

8. Third-Party Services

The App relies on third-party services, including Google AdMob for advertising, Google Firebase for analytics and crash reporting, and the Apple App Store for purchases. Your use of those services may be subject to their own terms and policies. We are not responsible for the practices of third parties.

9. Disclaimer of Warranties

The App is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that its tax rates or calculations will be accurate or current.

10. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of money, profits, or goodwill, arising out of or related to your use of (or inability to use) the App, including any reliance on its tax or tip calculations. Our total liability for any claim relating to the App shall not exceed the amount you paid us, if any, in the twelve months preceding the claim.

11. Termination

You may stop using the App at any time. We may suspend or terminate your access to the App or its services if you violate these Terms or if we discontinue the App. Provisions of these Terms that by their nature should survive termination — including disclaimers and limitations of liability — will survive.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of any changes by posting the updated Terms on this page and updating the "last updated" date. Your continued use of the App after changes take effect constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by the laws of the jurisdiction in which the App's developer operates, without regard to its conflict-of-laws principles. Nothing in these Terms limits any consumer rights that cannot be waived under applicable law.
